Default Image copyright

An advertiser has submitted an ad for my client's magazine. The ad includes what appears to be either a very low-rez JPEG or a video grab of bicyclists in a race -- maybe the Tour de France, the guy in front is wearing a U.S. Postal Service jersey.

I'm guessing that the photo/video was probably shot by a pro and copyrighted.

Do I need to worry about this? If the ad runs as is and an issue does come up about the photo copyright, would my client be liable (as the magazine's publisher), or the advertiser? Or me?

Should I have the client's ad rep contact the advertiser and bring up the issue?
